If you receive money that you know you are not owed, you do not get to keep it.

If you deposit the second check and they request it back, they can sue you for the return of the money - and they will win. You will have to repay the money. It is illegal - send the check back.

Stop and think about this. Let's say you owe $100 on a bill and you accidentally send them $200 instead. Does the company owe you the other $100? You know they do so why would you ask such a silly question?

Honesty is always the best policy unless you like orange jump suits and you prefer someone else locking and unlocking your doors at night.

And morally, it isn't yours so despite what the law says, you should want to be honorable and return it.

If you are only entitled to one check and receive two, you cannot deposit both. When they find out, they will request their money back. If you refuse, they will either take civil action against you to get their money or file criminal charges of theft by swindle. Either way, you are only entitled to the amount you settled for, even if you receive more than one check.
