hires Illegal Aliens .."? " Any company that hires illeagal aliens , The CEO will have a mandatory sentence of 2 years in prison" can this be made into law using ballot question just like the No smoking laws were?

Nope, it wouldn't be possible. First of all, it might violate due process if the CEO wasn't aware of the hiring. But more importantly, there is no provision for enacting federal law by way of ballot. Only Congress can enact federal law. Of course, such a law could be enacted at the state level through a ballot initiative, but it would immediately be struck down as being in conflict with federal law (as California' prop 187 was).

The united states has no provision for referenda. No way for the voters to vote directly on an issue. Most states have such a way for voters to directly enact state law, but there is no equivalent in the federal system.

Any laws that affect the United States as a whole have to originate from Congress ... whether it is a law or a Constitutional amendment. A Constitutional amendment addressing the penalty for hiring an illegal alien is extremely negligible.

Other than that, it would be up to each individual state to come up with their own laws. And these laws would not be able to conflict with Constitutional law or they will be stricken from the books.

Anyway, as far as whether the United States even wants a law like that, I have my doubts. If you would like to see the laws changed, my recommendation is to lobby your elected officials - both state and national - and let them know you vote and you talk to people about the issues who vote, as well.
